Are the terms “Brief Strategic Family Therapy” and “BSFT” valid trademarks owned exclusively by one party? Does this restrict the use of these terms by other individuals?
No. Even though a party may put the ™ (TM) and ® (R) symbols next to “Brief Strategic Family Therapy” or “BSFT”, this does not mean that the terms are valid trademarks. Attempts to register both terms on the principal register were rejected by the United States Patent and Trademark Office (USPTO) after a finding that the terms are merely descriptive and unsuitable for registration on the principal register. Evidence of these refusals is in the public domain, and can be found by visiting www.uspto.gov
